In queensland if a car sees a motor bike and still hits it can driver be charged?

2 Cars changed lanes into lane of bikerider

bike rider saw the cars change in front of him and the first car stopping

to avoid being hit by the second car bike rider goes into emergency lane

to avoid hitting first car second car goes into emergency lane also and collides with bike rider

car driver said he saw the bike rider in the emergency lane but still hit him

what can we charge the driver with?

bike is totalled and all riding gear is damaged

insurance has deemed bike rider at fault because he was in the emergency lane

as driver said he saw motor bike rider but the accident was the motor bike riders fault as he was in the emergency laneIn queensland if a car sees a motor bike and still hits it can driver be charged?I'd be very impressed if the car were able to see anything.

I'm not sure anyone in your scenario is going to be charged with anything. I guess they could be charged with unsafe lane change, reckless driving, failure to yield.

Interesting scenario....I don't really understand how the car hit the bike although he know so clearly where the bike was, that just sounds reckless. Why did the first car stop so abruptly? If it was an unforeseen stop, the bike rider was just trying to save himself, and rightly made the manoeuvre into the emergency lane. I tend to think the car that collided with the bike was at fault.
